SzuperChess j.d.o.o. (“SzuperChess”, "we", "us" or "our" as applicable) makes its data available to members of its group for the purpose of operating and promoting the various products and services of its group and members of its group may contact you about the various products they offer. We are committed to protecting and respecting your privacy. This policy (together with our Terms of Use and any other documents referred to in it) sets out the basis upon which any personal data we collect from you, or that you provide to us, will be processed by us. Please read the following carefully to understand our views and practices regarding your personal data and how we will treat it.
Introduction
This Privacy Policy describes the processes of collections, use and sharing of information provided by users of SzuperChess services, including information provided on websites, APIs, email notifications, applications, buttons, embeds, and received from its partners and other third parties. This includes information provided by users when using services on the web including the information from personal social media accounts used to register personal access to SzuperChess services and information processed by applications such as SzuperChess for iOS, SzuperChess for Android.
On using SzuperChess services the users shall provide their consent to the collection, transfer, storage, disclosure, and use of their information as described in this Privacy Policy. This includes any information users choose to provide, potentially of personal or indentifying nature under applicable law.
The users furthermore shall give consent to SzuperChess to be controller of their information under this policy. The data controller responsible for users’ information is SzuperChess j.d.o.o. (seat: Boškovićeva ulica 2, 10000, Zagreb, Croatia).
The new General Data Protection Regulation 2016/679 stipulates that the user alone shall control the information he/she provided to SzuperChess and any other content submitted to or associated with the use of services, as described in the Terms and Conditions. Irrespective of the chosen country of residence, the users of SzuperChess services shall give consent to transfer, store, and use of personal information. In some countries, the specific provisions of privacy and data protection laws may vary.
At SzuperChess we firmly believe in users’ right to privacy and take obligation to keep the user informed about the data SzuperChess collects from users of its services and how the information is used. SzuperChess goal is to enable users to make decisions regarding their privacy and personal information.
Information we may collect from you
It applies to you or to any other third party for whom you are paying the fees to register in any of our tournaments.We may collect and process the following data about you:
- Information that you provide by filling in forms on our website SzuperChess.com and any other websites or softwares, such as our anti-cheating system software, that we own containing our SzuperChess pages, products and services (our “Website”). This includes information provided at the time of registering to use our Website, subscribing to our products and services, registering in our tournaments, using our anti-cheating software, information required when you win a prize in order to investigate you, posting material or requesting further services. We may also ask you for information when you report a problem with our Website. Some of this information may be, but not limited to, your name, email, ID, birth date, birth country, nickname in other chess platforms, rating in other chess platforms or a photo of yourself.
- If you contact us or make any comments on our Website or post and forum entries we may keep a record of that correspondence.
- We may also ask you to complete surveys that we use for research purposes, although you do not have to respond to them.
- Details of transactions you carry out through our Website and of the fulfilment of your orders.
- Details of your visits to and actions on our Website including, but not limited to, traffic data, location data, weblogs, conversion data, behavioural data and other communication data.
- Information about your device, including where available your IP address, operating system and browser type.
- Recordings of your face and environment showed on your webcam, your audio and your screen when you are participating in our tournaments.
- Information collected from you after analyzing your face with our artificial intelligence anticheating system while playing the tournament or after having played it if you are suspicious and we need to make you some questions.
Creation of User Account Name
Creation of SzuperChess account is not compulsory for users to use some of the features of the services such as searching and viewing the SzuperChess tournaments replay on third-party websites, or viewing content from SzuperChess streamed on various third-party streaming services such as Facebook or Twitch. In order for user to create SzuperChess account, limited amount but not all of information regarded as “personal information” must be provided by the user of SzuperChess services.
Users shall note that they are not allowed to create and manage multiple user accounts for SzuperChess services.
Cookies
Our Website uses cookies to distinguish you from other users of our Website. This helps us to provide you with a good experience when you browse our Website and also allows us to improve our Website. Where we store your personal data
All information you provide to us is stored in infrastructure that is exclusively owned by us or exclusively licensed to us and that uses state of the art techniques to restrict access from third parties. Where we have given you (or where you have chosen) a password which enables you to access certain parts of our Website, you are responsible for keeping this password confidential. We ask you not to share a password with anyone. Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to our Website; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access.
We may delete some of your information collected from the tournaments from time to time, such as recordings.

Publicly accessible information
Some information generated by players of SzuperChess services may be accessible by the community of users such as information relating to the user community profile (name, country, club, etc.), ELO, profile picture, tournaments played or upcoming tournaments for which he/she has registered (with the correspondent results on each of them), special categories within each tournament, such as categories by ELO rating or age, and links to their profile in other gaming platforms.
We may make public any other information that we consider it is important to know for each tournament, provided that it is not sensitive information which cannot be shown by law, such as passwords, IDs or personal recordings.
Users shall be in full control of the personal data they reveal using SzuperChess services and in relation to the use of services, communication with the Support and shall be precautious about information accessible to the user community, especially if it is information of unique or sensitive nature. The user has opportunity to unilaterally updates, modifies or deletes his/her information accessible in relation to the use of SzuperChess services, deactivates and/or deletes his/her SzuperChess user account, and such decision shall have effect on the user’s information accessible on SzuperChess.com, SzuperChess for iOS, and SzuperChess for Windows. The right to deletion of information that identifies the user in relation to the use of specific services is known as the "right to be forgotten". SzuperChess has updated its Privacy Policy and has created processes to comply with the users' "right to be forgotten".
Users shall be aware that SzuperChess services may use technologies like application programming interfaces(APIs) and embeds to make information related to users available to websites, apps, and other third - parties for their use. This includes but it is not limited to displaying information on completed SzuperChess matches from different tournaments on third - party and social media websites such as Facebook, Youtube or Twitch in a form of an animated gif, live streaming or a link to a game replay linked to SzuperChess website SzuperChess.com or any other of our websites, such as our Facebook page www.facebook.com / SzuperChess.SzuperChess has endorsed standard terms that govern how such data is processed and used, and has maintained compliance program to enforce those terms.SzuperChess shall not be held responsible for how third - parties process and use such user information or in cases of data security breaches of the third - parties.
Your rights
You have the right to ask us not to process your personal data for marketing purposes. We will usually inform you (before collecting your data) if we intend to use your data for such purposes orif we intend to disclose your information to any third party for such purposes. You can exercise your right to prevent such processing by contacting us. Our Website may, from time to time, contain links to and from the sites of our partner networks, advertisers and affiliates. Access to information
You have the right to access to some information held about you. Your right of access can be exercised in accordance with applicable laws but must be made in writing to us. In certain circumstances access request may be subject to a fee of €10, or other reasonable fee, to meet our costs in providing you with details of the information we hold about you.
This is not applied to any kind of information collected about you during or after the tournaments, such as, but not limited to, recordings or the data extracted by the anti-cheating system software. This information is considered confidential and cannot be sent to any player, since it is used by us to combat cheating in online chess tournaments, which is the goal and main value of SzuperChess.
Changes to our privacy policy
Any changes we may make to our privacy policy in the future will be posted on this page and, where appropriate, notified to you by email or when logging into the Website.
Direct Messages and Non-Public Communication
SzuperChess offers features that allow users to communicate directly to each other. For example, users can use Direct Messages through Facebook, WhatsApp, Gmail or any other social media sites to have private conversations with other SzuperChess users or with a group of users. When users privately communicate with others such as by sending and receiving Direct Messages, SzuperChess stores and processes such communication, and information related to it. Users shall note that when they interact with the public SzuperChess content shared via Direct Messages, for instance by opening ongoing SzuperChess match via Direct Message, such activities may generate information accessible to the community of users. Users shall be aware that the content of communication such as Direct Messages used in direct and private communication as well as group communication, can be reproduced, copied, stored, and shared.
Information received from the third parties
SzuperChess may receive information about the users of its services from the third parties such as SzuperChess user community, business partners (including ad partners) and corporate affiliates. Partners and affiliates of SzuperChess may share user information such as a browser cookie ID, mobile device ID, or cryptographic hash of an email address, as well as demographic or interest data and content viewed or actions taken on a website or app.
Links
SzuperChess keeps track of how users interact with our chat to help improve and personalize their experience in using our services. For these purposes shared SzuperChess matches may be converted to clickable links. Email communication with the users of SzuperChess services and shared matches that appear on third-party websites and mobile applications may also contain such links.
By clicking on such links the users allow for information relating to their use of SzuperChess services together with other information associated with the specific content of such links to be shared with the third parties. Third parties may also collect other personal data from users of SzuperChess services including but not limited to cookie identifiers and users' IP addresses.
Service Providers
SzuperChess has standard contractual terms with other service providers in order to ensure the provision and functions of its services within and beyond the territory of the European Union.
Third-party services are used for the purpose of hosting our servers, databases, and analyze user behavior such as Google Analytics. SzuperChess may share personal information of its users with such service providers as stipulated under this Privacy Policy, and accepted standards of confidentiality and personal data protection and in accordance with applicable regulation.
Managing the User's Personal Information and Right to be Forgotten
All registered users of SzuperChess services are provided with tools and settings to access, modify, amend or delete the personal information provided to SzuperChess that serves the purpose of identification of users.
In accordance with General Data Protection Regulation 2016/679, all users are given opportunity to delete their user account at SzuperChess and information therein provided. The right to deletion of information that identifies the user in relation to the use of specific services is known as the "right to be forgotten". SzuperChess has updated its Privacy Policy and has created processes to comply with the users' "right to be forgotten".
Deletion and forgiveness of users is based on individual requests for deletion submitted to contact@szuperchess.com upon the receipt of which the user account is firstly deactivated and subsequently permanently deleted. Following deactivation and prior to permanent deletion of user information, the user profile and some of user information shall remain stored by SzuperChess for up to 30 calendar days and reviewable. The period of 30 calendar days offers opportunity to users to re-activate their account without losing any personal information. Unless otherwise agreed with the user, the process of deletion starts 30 days following deactivation and lasts for up to a week.
The users of SzuperChess shall note that search engines and other third parties may still retain copies of their information that was publicly accessible, even after permanent deletion of user profile.
Privacy law in certain jurisdictions
The users of SzuperChess services provide consent to SzuperChess to transfer, store, and use their data in jurisdictions which can be different from the jurisdiction of the user. Some jurisdictions may have different privacy and data protection law from jurisdictions where the user is a resident and may vary from country to country.
The transfer of personal data outside of the European Union or members of EFTA is ensured by applicable regulation of specific jurisdictions where data is stored as well where user is a resident. Third parties engaged in the transfer are liable for the breach of privacy and data protection laws of the country where user is resident as well as generally accepted privacy standards in the European Union and the United States of America. SzuperChess as well as its affiliates, partners and third-parties engaged in services shall comply with applicable regulation regarding the collection, use, sharing, and retention of personal data from the European Union.
